How this website handles personal data: under the revised Swiss Data Protection Act, briefly and without evasion.

This statement follows the revised Swiss Data Protection Act (revFADP), which came into force on 1 September 2023.

OLD FOR YOUNG is being founded and will become a public limited company (Aktiengesellschaft) with its head office in Muntelier this year. For any data protection matter, an email or a letter to the address below is enough.

Which data is processed

We only process data that you send us yourself, plus the technical data that inevitably arises when a website is operated. Nothing is collected in the background.

  • Details from a registration of interest: your name, your email address, optionally a telephone number, the type of apartment you are interested in, and your message.
  • Any further details you volunteer in an email, for example about your situation, your preferred timing or the size of your household.
  • Server log data from the hosting provider: the page requested, date and time, the amount of data transferred, browser type, operating system, the referring page and the IP address.

There are no user accounts on this website; registration is neither possible nor necessary. We do not ask for anything that is not needed to deal with your enquiry.

Purpose and legal basis

We process the details from a registration of interest in order to answer your enquiry, to keep you informed about the progress of the project if you wish, and to maintain the interest list.

Server log data serves the secure and stable operation of the website and the prevention of misuse. It is not used for any analysis.

Under the revised Swiss Data Protection Act the legal basis is your consent, given when you send us your message, together with our overriding interest in operating this website. We process the data solely for the stated purpose. It is never used for third-party advertising.

The interest list

When you register interest in an apartment, we record your details in a list. It holds your name, your contact details, the type of apartment you are looking for, your message and the date of your enquiry.

We record the date on purpose: interested parties are considered in the order in which they got in touch. That order is therefore itself part of the data we process. You can ask at any time what has been recorded about you.

The list is not published, not passed on and not sold. Only the people working on the project have access to it.

You can have your entry removed at any time and without giving a reason. An email is enough. You will then no longer be considered in the allocation, but there is no other disadvantage.

The contact form opens your own email program

The form on the contact page sends nothing to a server belonging to this website. It gathers your entries in the browser, assembles them into a finished email and opens your own email program with it. The message is only sent when you send it yourself.

That has two consequences we would rather state plainly. First, we only see your entries once your email reaches us. As long as you do not send the draft, nothing of it exists on our side. Second, the transmission runs through your own email provider and is subject to that provider's terms. We have no influence over that path.

If no email program is set up on your device, nothing will open. In that case please write to us directly at the address given above.

Hosting

The website is operated by a hosting provider located in Europe. The provider processes data on our behalf and is contractually bound to data protection and to appropriate technical security measures.

When a page is requested, log data arises for technical reasons. Without it a website cannot be operated or protected against attacks. This data is not combined with other sources and is not used to identify individual visitors.

Cookies and analytics

This website sets no analytics cookies. There is no audience measurement, no tracking, no profiling and no recognition across visits.

Nor are any third-party services embedded: no fonts loaded from external servers at runtime, no embedded maps, no video platform, no social plugins, no advertising networks. Fonts and images sit on the same server as the website.

That is why no cookie banner appears here. There is simply nothing for you to agree to.

Disclosure to third parties

We pass on your data only as far as it is needed to deal with your enquiry, and only to bodies involved in the Bären project. That may be the architects or a body later entrusted with sales.

Beyond that, we disclose data only where we are required to do so by law or where an authority lawfully demands it.

Data is never sold. No transfer to countries outside Switzerland and the European Economic Area is planned.

Your rights under the revised Swiss Data Protection Act

As a data subject you have the following rights under the revised Swiss Data Protection Act:

  • Access: you can find out at any time whether and which data about you we process, where it came from and for what purpose it is processed.
  • Rectification: you can have inaccurate or incomplete data corrected or completed.
  • Erasure: you can request the deletion of your data, provided no statutory retention obligation stands in the way.
  • Objection: you can object to the processing and withdraw consent at any time. A withdrawal takes effect for the future.
  • Data portability: you can receive the data you have given us in a common electronic format, or have it transferred to another body.

An email to the address given above is enough. We deal with your request free of charge and without asking why. So that we do not give information to the wrong person, we may in individual cases ask for proof of your identity.

If you are not satisfied with our answer, you can turn to the Federal Data Protection and Information Commissioner (FDPIC) in Bern.

Retention and deletion

We keep personal data only as long as it is needed for the purpose in question. After that it is deleted.

  • Enquiries without a registration of interest: until they are dealt with, and for a maximum of twelve months thereafter.
  • Entries in the interest list: as long as the Bären project is in development, at the latest until the allocation is complete plus a reasonable grace period.
  • Server log data: within the hosting provider's usual retention, as a rule a few months.

On request we delete earlier. Where statutory retention obligations exist, we block the data against further processing until the period has expired and delete it afterwards.

Visitors from the EU

This statement follows Swiss law. If you access the website from the European Union, the General Data Protection Regulation (GDPR) applies to you in addition.

In that case the legal basis is your consent under Article 6(1)(a) GDPR for the details from a registration of interest, together with our legitimate interest under Article 6(1)(f) GDPR in operating the website securely.

You have the rights set out in Articles 15 to 21 GDPR: access, rectification, erasure, restriction of processing, data portability and objection. You may also lodge a complaint with a supervisory authority in your country.

The European Union recognises Switzerland as providing an adequate level of data protection. No additional safeguards are therefore required for transferring your data to Switzerland.

Changes to this statement

We adapt this statement when the website, the project or the legal situation changes. The version published here is always the one that applies.
